1. Read this first
These Terms of Use are a binding contract between you and the operator of propertyhubmiami.com. Read them before you use the site.
THESE TERMS CONTAIN A JURY TRIAL WAIVER, A LIMIT ON OUR LIABILITY OF US $100, AN INDEMNITY YOU OWE US, AND AN AGREEMENT THAT DISPUTES WILL BE HEARD IN THE STATE AND FEDERAL COURTS IN BROWARD COUNTY, FLORIDA. THEY ALSO RESTRICT WHAT YOU MAY DO WITH THE MLS LISTING DATA ON THIS SITE. SEE THE SECTIONS TITLED "MLS AND IDX LISTING DATA," "LIMITATION OF LIABILITY," "INDEMNIFICATION," AND "DISPUTES."
We do not require you to arbitrate disputes with us, and nothing here waives your right to bring a class action or to complain to a regulator.
2. Who operates this site
PropertyHub Miami is a trade name for a real estate website operated by Anna Bogomazova, a real estate licensee in the State of Florida. It is not currently a separate legal entity. Anna Bogomazova's license is held with Star Alliance Realty, a licensed Florida real estate brokerage, and Star Alliance Realty is the brokerage of record for all real estate brokerage services described, advertised, or requested through this site.
PropertyHub Miami is not itself a brokerage. Wherever this document says "we," "us," or "our," it means Anna Bogomazova operating under Star Alliance Realty. If the ownership or brokerage arrangement changes, we will update this section and the "Last updated" date.

We do not sell goods, subscriptions, or services through this site, and we do not process payments here. Properties advertised on this site are offered for sale or lease by their owners and their listing brokers, not by us.
The site does not currently offer visitor accounts, logins, or passwords. An administrative content-management login exists at /studio for the people who edit the site's editorial content; it is not available to visitors and it is excluded from search engines. If we later add visitor accounts, saved profiles, or paid services, those features will be governed by these Terms together with any additional terms we show you at the point you register or pay.
3. Accepting these terms
There are two levels.
By accessing or using any part of this site in any way — viewing a page, running a search, saving or comparing a property, opening a virtual tour, using any tool we offer now or add later — you accept, as a condition of that access, the sections titled "No brokerage, agency, or fiduciary relationship," "MLS and IDX listing data," "Your license to use the site," "Automated access, scraping, and AI training," "Other prohibited uses," and "Our content and trademarks." Those sections define the permission you have to be here. If you do not accept them, stop using the site.
By submitting any form on this site you accept all of these Terms, including the disclaimers, the liability limit, the indemnity, and the section titled "Disputes."
You must be at least 18 years old to submit a form. The site is meant for adults and is not directed to children. We do not knowingly collect information from a child below the minimum age set by the law that applies to that child — currently 13 in the United States, and as high as 16 in parts of the European Economic Area and the United Kingdom. If you believe a child has sent us information, email hello@propertyhubmiami.com and we will delete it by hand.
These Terms are published in English only. The site's Russian, Spanish, Arabic, and Portuguese versions display this English text. The English text is the version that controls.
4. No brokerage, agency, or fiduciary relationship
Using this site does not make us your agent.
Using any part of this site — browsing, searching, saving, comparing or shortlisting properties, requesting a valuation, using any other feature we offer now or in the future, or submitting any inquiry form — does not by itself create a single agent relationship, a fiduciary relationship, or any duty of loyalty, obedience, or full disclosure between you and Anna Bogomazova or Star Alliance Realty.
Florida's brokerage relationship statute — currently Fla. Stat. § 475.278, as amended, renumbered, or replaced — presumes that a licensee dealing with a member of the public operates as a transaction broker, and that presumption carries the limited statutory duties the statute sets out, including dealing honestly and fairly, accounting for all funds, using skill, care, and diligence, disclosing material facts about the property that are not readily observable, presenting offers in a timely way, and limited confidentiality. A single agent relationship, or a no-brokerage-relationship arrangement, is established only by the separate written disclosure the statute prescribes, given to you before we show you property.
Nothing on this site waives, limits, or disclaims any duty a Florida real estate licensee owes under Chapter 475, Florida Statutes. A website cannot do that, and we are not trying to.
If you are already represented by another broker under a listing agreement or a buyer-broker agreement, nothing on this site is a solicitation to breach that agreement. Tell us, and we will direct you back to your own broker.
Information you send us through a form is an inquiry. It is not an offer, not an acceptance, not a reservation of a property, and not a contract to buy, sell, or lease anything. Contracts for real property must be in writing and signed to be enforceable.
5. Nothing on this site is professional advice
Everything on this site is general information for your own research. It is not legal advice, tax advice, accounting advice, financial or investment advice, mortgage advice, insurance advice, immigration advice, or an appraisal. Talk to a lawyer, a CPA, a licensed lender, or a state-certified appraiser before you rely on any number you find here.
This applies to every calculator, estimator, chart, statistic, score, or data tool on the site, including any we add after these Terms were last updated. Three deserve specific mention.
- Mortgage calculator. It performs arithmetic on the figures you type in. Its starting rate comes from the Freddie Mac Primary Mortgage Market Survey series published by the Federal Reserve Bank of St. Louis (FRED series MORTGAGE30US and MORTGAGE15US), which we refresh once a week. That is a national average. It is not a rate available to you, it is not specific to any property or loan product, and it changes. The output is an illustration — not a loan offer, not a pre-approval, not a rate lock, not a quote. Your actual rate, payment, taxes, insurance, association dues, and closing costs will differ. Only a licensed lender can tell you what you qualify for.
- Market trends. Charts and statistics are derived from the MLS data we hold at the time the page is generated. They describe the past. They do not predict future prices, rents, or returns, and they are not a valuation of any specific property.
- Home valuation request (labeled "Instant Estimate" on the site today). When you type an address, that address is sent to our geocoding provider, Mapbox, before you submit anything, and the tool shows you statistics about nearby active listings drawn from our MLS data. If you then ask for the analysis, we store the address with your email address and a person prepares a comparative market analysis. Any figure the site or we give you — prepared by a person or generated automatically — is an estimate. It is not an appraisal, not a guarantee of value, not a listing-price recommendation, and not a valuation any lender may rely on. Only a state-certified appraiser can appraise a property.
Neighborhood guides, building profiles, preconstruction write-ups, blog posts, and map data are editorial or third-party content, are not part of the MLS listing, and may be incomplete or out of date.
6. MLS and IDX listing data
6.1 Where the data comes from
Property listings on this site are supplied through the Internet Data Exchange (IDX) program of the MIAMI Association of REALTORS® (the "MLS"). The data reaches us over a licensed feed from Bridge Interactive (api.bridgedataoutput.com), which delivers the MIAMI dataset. We display that data under license. We are not its owner.
6.2 Who owns the data
The MLS compilation and each individual listing — including listing photographs, virtual tours, floor plans, public remarks, and other listing content — are the property of the MLS and of the listing brokers and their photographers and content providers, and are protected by copyright. Listing data displayed on this site is copyrighted by the MIAMI Association of REALTORS® and by the listing brokers; all rights reserved. We claim no copyright in listing content and we grant you no rights in it. Any use of listing photographs or descriptions beyond what the next subsection permits requires permission from the copyright owner. Our own copyright notice on this site covers our own material and does not extend to listing content.
6.3 What you may do with it — personal, non-commercial use only
The information being provided is for consumers' personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing.
As a condition of your permission to view this site, you agree that:
- You have a bona fide interest in the purchase, sale, or lease of real estate.
- You will not copy, redistribute, or retransmit any listing information except in connection with your own consideration of the purchase, sale, or lease of an individual property.
- You will not, directly or indirectly, display, post, disseminate, distribute, publish, broadcast, transfer, sell, license, or sublicense any listing information or related data to any other person or entity.
- You will not compile, store, re-organize, summarize, index, aggregate, or otherwise manipulate listing information to create a database, dataset, index, feed, mailing list, lead list, market report, model, or product of any kind, whether or not you charge for it.
- You will not use this site or its content to develop, market, or support a competing product, service, or data set.
These restrictions pass through obligations we owe to the MLS. They apply whether or not you are a licensed real estate professional, and they survive any termination of your access.
6.4 Accuracy — deemed reliable but not guaranteed
Listing information is deemed reliable but is not guaranteed accurate by the MLS or by us. We do not create, verify, correct, or independently confirm listing content. Square footage, lot size, room counts, year built, taxes, association dues, zoning, permits, school assignments, flood and insurance information, and rental or short-term-rental eligibility are frequently wrong in source records and must be independently verified by you and your own professionals.
All properties are subject to prior sale, lease, price change, contract, financing contingency, withdrawal, or removal from the market without notice. A listing shown here as available may already be under contract, sold, leased, expired, or withdrawn. We make no representation that a listing is still available when you view it.
We pull a fresh feed every 30 minutes and reconcile the full inventory once a day at 3:00 a.m. Eastern time. MLS rules require a refresh at least every 12 hours, and we meet that. Pages may be cached between refreshes. The date shown with a listing is when the record was last received from the feed, not the current status of the property. Confirm status with us or with the listing broker before you act.
6.5 Attribution and integrity of listing data
Listing detail pages display the name of the listing firm for listings held by brokerage firms other than Star Alliance Realty. You may not suppress, remove, alter, obscure, reduce, crop, watermark, overlay, or otherwise manipulate listing data, listing photographs, pricing, or listing broker attribution as displayed on this site, and you may not present listing content in a way that misstates its source.
Except where a listing page expressly states otherwise on its face, nothing on this site is an offer of compensation to any broker, and no such offer may be inferred from any listing, price, or field displayed here.
6.6 MLS access for compliance review
We authorize employees, members, and duly authorized representatives of the MLS to access this site, including by automated means, for the purpose of verifying compliance with MLS rules and monitoring the display of participants' listings.
6.7 Who benefits from these disclaimers
The MLS and the listing brokers whose listings appear on this site are intended third-party beneficiaries of the sections titled "MLS and IDX listing data," "Automated access, scraping, and AI training," "Disclaimer of warranties," "Limitation of liability," and "Indemnification," and may enforce them directly. The MLS is not responsible or liable, directly or indirectly, for any loss or damage of any kind arising from your use of or reliance on any listing information displayed here.
7. Preconstruction and new development
Preconstruction and new-development pages on this site are built from information supplied by developers and their sales teams. That information is not MLS data, we do not verify it, and it changes without notice.
Renderings and interior images are artists' conceptions. They do not depict as-built condition. Pricing, availability, unit mixes, floor plans, square footages, finishes, amenities, association dues, and estimated completion dates all change, and projects are sometimes redesigned or cancelled.
Nothing on these pages is an offer to sell or a solicitation of an offer to buy where such an offer or solicitation is prohibited or requires registration that has not been made. For a Florida condominium, the developer's prospectus, offering circular, and purchase agreement control — see Fla. Stat. §§ 718.503–718.504, as amended. Rely on those documents, not on anything published here.
8. Your license to use the site
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to view and use this site for your own personal, non-commercial purposes. That is all.
These Terms do not give you a license to reproduce, distribute, display, frame, mirror, embed, republish, or provide access to any portion of this site or its content on any other website, application, service, feed, or platform. All rights not expressly granted are reserved. This license terminates automatically if you breach these Terms.
9. Automated access, scraping, and AI training
Access to this site is conditioned on this section. We republish licensed MLS data under an agreement that forbids redistribution, and unauthorized extraction from this site puts that license at risk.
We permit general-purpose search engine crawlers that identify themselves accurately and obey the directives in our robots.txt file, and we permit access by the MLS for the compliance purposes described above. All other automated access is prohibited.
Subject to those two exceptions, you may not, and may not permit, assist, encourage, or engage anyone else to:
- access, crawl, query, index, harvest, or retrieve any part of this site or its content by any automated or programmatic means, including robots, spiders, crawlers, scripts, bots, headless browsers, browser automation frameworks, agents, extensions, downloaders, or any other manual or automatic device, tool, or process
- perform screen scraping, database scraping, HTML parsing at scale, API replay, or bulk downloading of pages, listing records, images, media, or map tiles
- circumvent, disable, or interfere with any anti-spam, abuse-prevention, rate-limiting, throttling, or access-control measure we use, of any kind
- rotate IP addresses, proxies, user agents, or devices, or use residential or datacenter proxy networks, to evade any such measure
- extract, copy, or reconstruct all or any substantial part of the listing data, the property database, the media library, the geographic data, or the editorial content, whether in a single act or by repeated access over time
- use any content from this site — including listing data, listing photographs, listing remarks, market statistics, neighborhood and building content, blog posts, and site copy — to train, fine-tune, validate, evaluate, benchmark, ground, retrieve into, index for, or otherwise develop or improve any machine learning model, large language model, generative or agentic AI system, embedding, vector or semantic index, or any other automated, statistical, or successor technology serving a comparable purpose, whether or not that technology exists or is known by that name today, or any derivative data set, unless we have authorized it in writing
- probe, scan, or test the vulnerability of the site or its infrastructure, or place an unreasonable or disproportionate load on it.
Our `robots.txt` file, sitemaps, meta robots directives, and HTTP headers — or the absence of any of them — do not expand your rights and do not modify, waive, or limit any prohibition in this section. Those files define the crawl budget we make available to search engines. They are not a license to anyone else. Permission for any other automated access must come from us in writing, in advance.
If you want listing data for a legitimate purpose, contact the MLS. Do not take it from here.
10. Other prohibited uses
You also agree not to use the site to:
- violate any law, or any rule of any multiple listing service, association, or regulator whose rules apply to us or to the data displayed here — currently including the MIAMI Association of REALTORS®, the National Association of REALTORS®, and the Florida Real Estate Commission
- discriminate, or assist anyone in discriminating, against any person or class of persons protected under federal, state, or local fair housing law, including by asking us to steer you toward or away from an area on the basis of a protected characteristic
- harvest or collect the names, email addresses, phone numbers, or license information of real estate professionals, property owners, or other visitors, for solicitation or any other purpose
- submit false, misleading, or impersonated information through any form, or submit an inquiry on behalf of another person without that person's authorization
- send spam, chain messages, malware, or automated form submissions
- upload or transmit anything unlawful, defamatory, harassing, obscene, infringing, or invasive of anyone's privacy
- interfere with the operation of the site, or attempt to gain unauthorized access to any system, network, or data connected to it
- remove, obscure, or alter any copyright, trademark, license, disclaimer, or attribution notice.
11. Forms, submissions, and communications
11.1 What you send us, and what happens to it
The site currently has five inquiry forms: a general contact form, a listing inquiry and viewing request, a preconstruction information request, a newsletter signup, and a home valuation request. The same forms are sometimes presented inside a modal, a slide-in panel, or an exit-intent panel. The forms we offer and the fields they collect change over time.
Depending on the form, we ask for your name, email address, an optional phone number, a free-text message, and context about what you are asking about — a listing identifier and address, a project name, or a property address and property type. The newsletter signup and the exit-intent panel ask only for an email address.
Here is what happens when you submit one:
- The submission is stored as a row in our database, hosted by Neon, together with the IP address the submission came from. That IP address sits in the same record as your name, email, phone number, and message.
- A notification email is sent to us, and in some cases a confirmation email to you, through our email provider, Resend.
- Your email address and your IP address are used as rate-limit keys with our rate-limiting provider, Upstash, so your email address is transmitted to and briefly held by that provider. The same limits run against our own database as a fallback.
- Most of our forms include a hidden anti-spam field that a human visitor never sees. A submission that fills it is discarded — it is not stored and it is not forwarded to us, even though the page shows a confirmation. If you submit a form and do not hear back from us, call (305) 360-9675 or email hello@propertyhubmiami.com directly.
We do not currently apply an automatic retention limit to these records. They are kept until we delete them. There is no self-service deletion and no automated purge. If you want your record deleted, email hello@propertyhubmiami.com; we delete it by hand and we aim to do that within 30 days. Our Privacy Policy describes our handling of this data in more detail; if it and this section differ, the Privacy Policy controls.
11.2 Accuracy of what you submit
You agree that the information you submit is accurate and that it is yours to submit. Do not send confidential, sensitive, or privileged material through a form. Do not send Social Security numbers, passport or visa numbers, other government identification numbers, bank or card numbers, passwords, or health information — we do not ask for them, and a web form is the wrong channel for them. Our FAQ discusses financing, visas, and taxes for foreign buyers; those conversations belong on a call, not in a text box. Free-text fields are stored as written and forwarded to us by email. Treat them as you would an ordinary unencrypted email.
11.3 The license you give us
You keep ownership of what you submit. You grant us a non-exclusive, worldwide, royalty-free license to use, store, copy, and transmit your submission for the limited purpose of responding to your inquiry, providing the service you asked for, keeping the records a real estate licensee is required to keep, and defending or enforcing our rights. We do not claim any broader license, and we do not publish, sell, or license your submission to third parties for their own marketing.
11.4 How we may contact you
If you submit a form, you are asking us to reply, and you agree that we may contact you about that inquiry at the email address and phone number you gave us — by email, by phone, or by text message sent by a person.
We do not currently operate an automated SMS program, an autodialer, or a prerecorded-voice campaign, and we do not sell your contact information. If we introduce any of those, we will obtain the consent the law requires before enrolling you, we will identify the messages as marketing, and you will be able to opt out.
The newsletter signup sends you one welcome email. We do not currently run an automated mailing list, and our emails do not yet carry an unsubscribe link. To stop hearing from us, reply to any email, reply STOP to a text, tell us on a call, or email hello@propertyhubmiami.com. We act on the request by hand, within 10 business days and sooner where the law requires it, and we delete the record. Automated confirmations relating to something you asked for are not marketing and may continue until that request is closed.
Message and data rates may apply to any text messages, and message frequency varies.
11.5 What the site stores on your device
The site sets no cookies of its own. It does store small values in your browser's local and session storage, which stay on your device and are not sent to us:

Nothing here identifies you to us. Clearing your browser storage removes all of it, and your saved and compared listings with it.
The cookie banner records your acknowledgement and hides itself. It does not currently gate any script, provider, or storage write, and dismissing it does not change what loads. Our analytics — Vercel Analytics and Vercel Speed Insights — run on every page view regardless of the banner. Embedded players and other third-party services may set their own cookies in your browser when you open them.
12. Our content and trademarks
The design, layout, code, structure, original photography, and original editorial content of this site — including neighborhood guides, building profiles, preconstruction write-ups, market commentary, blog posts, and site copy — are owned by us or our licensors and are protected by copyright and other laws. You may view them and print or save individual pages for your own personal use. You may not republish, redistribute, resell, or create derivative works from them without our written permission.
PropertyHub Miami and our logos are our marks. REALTOR®, REALTORS®, the REALTOR® block-R design, and the names, logos, and marks of each multiple listing service and association whose data or membership we use — currently including the MIAMI Association of REALTORS® — belong to their respective owners and are used under their rules. Third-party product and vendor names are the marks of their owners. Nothing here grants you any right to use any of these marks.
Our copyright in this site does not extend to MLS listing content.
13. Third-party services
This site depends on providers we do not control, and some of them receive your IP address, your browser user-agent, and the page you were viewing directly from your browser. The providers we use today:
- Listing photographs and virtual tour media load straight into your browser from MLS-operated content delivery networks —
photos.simplyrets.comand Amazon CloudFront. We do not proxy or re-host them, so those hosts see your requests. - Listing data comes from Bridge Interactive under the MIAMI Association of REALTORS® IDX feed.
- Editorial content is managed in Sanity, and Sanity's CDN serves those images to your browser.
- Map tiles are served from a Cloudflare Worker we operate, which sees which map areas you look at. Address lookups on the valuation tool are resolved by Mapbox.
- Virtual tours and videos play inside embedded third-party players — Matterport, YouTube, and Vimeo — which load when you open them.
- Hosting and analytics are Vercel, including Vercel Analytics and Vercel Speed Insights on every page view. Database is Neon. Rate limiting is Upstash. Email delivery is Resend. Mortgage rate data comes from the Federal Reserve Bank of St. Louis FRED API.
These services are provided "AS IS." We do not control them, we do not endorse them, and we are not responsible for their content, availability, accuracy, or practices. Opening an embedded player or following an outbound link takes you into someone else's service, governed by their terms and their privacy policy. We may change providers at any time; the current list lives here and in our Privacy Policy, and a change of provider does not change these Terms.
Outbound links are provided for convenience. A link is not an endorsement or a representation about the linked site.
14. Fair Housing and Equal Housing Opportunity
PropertyHub Miami and Star Alliance Realty comply with the federal Fair Housing Act, the Florida Fair Housing Act, and applicable local fair housing ordinances. We do not discriminate, and we will not assist anyone in discriminating, on the basis of race, color, religion, sex, disability, familial status, or national origin, or any other characteristic protected by applicable federal, state, or local law — which in the markets we serve also currently include sexual orientation, gender identity, marital status, age, and source of income.
All real estate advertised on this site is available on an equal opportunity basis. We will not steer you toward or away from any neighborhood, building, or property on the basis of any protected characteristic, and we will not answer questions framed that way. Ask us about schools, commutes, amenities, and price, and we will point you to the sources.
Listing remarks and photographs are written by listing brokers and are displayed as the MLS supplies them; we are not permitted to edit them. If you see listing content that appears to violate fair housing law, tell us at hello@propertyhubmiami.com and we will report it to the MLS.
15. Accessibility
This site is built to work with screen readers, keyboard navigation, magnification, and other assistive technology. We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.2 at Level AA, we treat accessibility problems as bugs, and that work is ongoing — we have not certified conformance.
Parts of the site come from third parties and are outside our direct control: MLS listing text and photographs, embedded virtual tours and videos, and map tiles rendered to a canvas.

16. Copyright complaints (DMCA)
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512, as amended. If you believe content on this site infringes your copyright, send a written notice to our designated agent.

16.2 What your notice must contain
Your notice must include everything the statute requires, which currently is:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if one notice covers multiple works at a single site, a representative list of them.
- Identification of the material claimed to be infringing, with enough information for us to locate it — the page URL, the listing identifier, and which photograph.
- Enough information for us to contact you: your address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Incomplete notices may not be actionable. Misrepresenting that material is infringing can make you liable for damages, including costs and attorneys' fees, under § 512(f).
16.3 Listing photographs
Most photographs on this site arrive through the MLS feed and are hosted by the MLS or its vendors. We cannot edit an MLS record, and our sync rewrites each listing's media from the feed on every run, so deleting a single image would not hold. When we receive a valid notice about MLS-sourced media, we remove the affected listing page from display and refer the complaint to the MLS, which controls the underlying record. The page returns only after the MLS resolves it.
16.4 Counter-notification
If your material was removed and you believe the removal was a mistake or a misidentification, send a counter-notification to the agent above containing: your physical or electronic signature; identification of the material and where it appeared before removal; a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification; and your name, address, and telephone number, together with your consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which we may be found) and your agreement to accept service of process from the complaining party.
16.5 Repeat infringers
We have adopted and reasonably implement a policy of terminating, in appropriate circumstances, the access of visitors who repeatedly infringe copyright. This paragraph is that policy, and posting it here is how we communicate it.
17. Termination and revocation of access
Your permission to access and use this site is revoked automatically if you breach these Terms. We may also block, rate-limit, restrict, or terminate your access at any time, with or without notice, at our discretion, including where we believe automated access, data extraction, or misuse of listing data is occurring. If you access the site after we revoke your permission, that access is unauthorized and may violate the Computer Fraud and Abuse Act, 18 U.S.C. § 1030, and Fla. Stat. § 815.06.
We may also change, suspend, or discontinue any part of the site at any time. We do not promise uninterrupted or error-free availability.
The sections titled "Accepting these terms," "No brokerage, agency, or fiduciary relationship," "MLS and IDX listing data," "Preconstruction and new development," "Automated access, scraping, and AI training," "Other prohibited uses," "Forms, submissions, and communications," "Our content and trademarks," "Third-party services," "Copyright complaints (DMCA)," and every section after this one survive any termination or revocation of your access.

Some jurisdictions do not allow some of these limitations; this section applies only to the extent permitted.
This limit allocates risk on a site that is free to use and that republishes data we do not control. It is a basic part of the bargain between us.
20. Indemnification
You agree to defend, indemnify, and hold harmless Anna Bogomazova and Star Alliance Realty, together with their officers, employees, and agents, from any claim, demand, loss, liability, or expense arising out of: your automated access to or extraction from the site; your copying, redistribution, or commercial use of listing data; any content you submit through a form; or your breach of these Terms or violation of any law or third party's right in connection with your use of this site.
Reasonable attorneys' fees are recoverable under this section only where your breach was willful.
We may assume the exclusive defense and control of any matter subject to indemnification by you, at our own expense, and you agree to cooperate with that defense. You will not settle any matter affecting us without our written consent.
21. Disputes
21.1 Governing law
These Terms and any dispute arising out of or relating to them or to this site are governed by the laws of the State of Florida, without regard to its conflict of laws principles.
21.2 Talk to us first
Before starting a court proceeding, try to resolve the dispute with us informally. Send a written notice describing the dispute, what you want, and how to reach you, to hello@propertyhubmiami.com or to 1720 Harrison St STE 18B, Hollywood, FL 33020. Neither of us should begin a formal proceeding until 60 days after that notice is received, unless the claim qualifies for small claims court or seeks emergency injunctive relief.
Any applicable limitations period is tolled while this process is running. Failure to complete it is not a jurisdictional bar; it is grounds to ask a court to stay the proceeding until it is done.
21.3 JURY TRIAL WAIVER
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WE EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THIS SITE OR THESE TERMS.
21.4 Where disputes are heard
You and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Broward County, Florida — the county where our office is located — and waive any objection to that venue. Either of us may still bring an individual claim in small claims court if it qualifies, and either of us may seek temporary or preliminary injunctive relief in any court of competent jurisdiction to stop unauthorized access to the site, scraping, or misuse of listing data or intellectual property.
21.5 Complaints to regulators
Nothing in these Terms prevents you from filing a complaint with any government agency that has jurisdiction — including any state real estate regulator, state consumer protection agency, or fair housing or federal consumer protection agency. In our market those are currently the Florida Real Estate Commission, the Florida Department of Agriculture and Consumer Services, the U.S. Department of Housing and Urban Development, and the Federal Trade Commission.
22. Electronic communications and records
You consent to transact with us electronically and to receive notices, disclosures, and agreements from us electronically, at the email address you give us or by posting on this site. You agree that electronic signatures, acceptances, and records satisfy any legal requirement that a communication be in writing or signed.
To do this you need a device with a current web browser, an internet connection, and a working email address. You may withdraw this consent, or ask for a paper copy of anything we sent you electronically, by emailing hello@propertyhubmiami.com; withdrawing it may mean we can no longer respond to a web inquiry.
23. Changes to these Terms
We may update these Terms. When we do, we post the updated version on this page and change the "Last updated" date at the top. Changes apply from the date they are posted and do not affect a dispute that has already arisen.
We do not maintain user accounts. If you have given us an email address, we may tell you about a material change at that address, but we are not required to, and the posted date is the notice that counts. Your continued use of the site after a change means you accept the updated Terms. If you do not accept them, stop using the site.
24. General
Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent needed to make it enforceable and to reflect its original intent, and the rest of these Terms stays in effect.
Entire agreement. These Terms, together with our Privacy Policy (/privacy) and our IDX Disclaimer (/idx-disclaimer), and any successor or additional policies we publish on this site, are the entire agreement between you and us about this site, and they replace any earlier version. They do not replace or modify any separate signed agreement between you and Star Alliance Realty, which controls as to its own subject matter. A printed version of these Terms, and of any notice given electronically, is admissible in any proceeding to the same extent as other business records kept in printed form.
No waiver. If we do not enforce a provision, that is not a waiver of it, and it does not prevent us from enforcing it later.
Assignment. You may not assign or transfer these Terms or any rights under them without our written consent. We may assign them, in whole or in part, without notice, including to a successor brokerage, entity, or acquirer of the site or the business.
No third-party beneficiaries. There are no third-party beneficiaries to these Terms except the MLS and the listing brokers, as stated in the section titled "MLS and IDX listing data."
No agency. Nothing in these Terms creates a partnership, joint venture, employment, franchise, or agency relationship between you and us. Brokerage relationships are governed by the section titled "No brokerage, agency, or fiduciary relationship."
Statutory references. Every statute and rule cited here means that provision as amended, renumbered, or replaced from time to time.
Headings. Headings and section numbers are for convenience. They do not affect interpretation, and a court should not give them independent legal effect. Where a section refers to another by title, the title controls.
Force majeure. We are not liable for any failure or delay caused by events outside our reasonable control, including outages at any hosting, data, network, or MLS provider.
Language. These Terms are published in English. The English version controls.
